Record Recoveries
We have taken on corporate giants like Bristol-Myers Squibb, Waste Management, and El Paso Energy, and are currently serving as lead or co-lead counsel in cases against American International Group, HealthSouth, St. Paul Travelers, General Motors, and IBM, among many others.
We have obtained both record monetary recoveries and crucial corporate governance reforms for our clients.
For example, representing the Connecticut Retirement Plans and Trust Fund as Lead Plaintiff in In re Waste Management, Inc. Securities Litigation, our team recovered $457 million and reached an agreement that included extensive corporate governance reforms designed to strengthen the role and independence of the audit committee and improve accountability through change-in-board structures and the protection of whistleblowers.
In announcing this settlement, Connecticut State Treasurer Denise Nappier noted, “we achieved more money in less time at a lower cost than in any previous Class Action case in U.S. history.”
A Firm of Firsts
Since passage of the Private Securities Litigation Reform Act (PSLRA), Labaton Sucharow attorneys have been out in front, helping institutional investors to lead the charge against corporate fraud and wrongdoing.
We represented an affiliate of one of the United States’ ten largest banks as the first major private institutional investor to become a lead plaintiff in a class action under the PLRSA. We also had the first successful jury trial and verdict of Section 14 claims under the PSLRA which challenged the disclosures in a proxy and resulted in a $184 million jury verdict.
In addition, Labaton Sucharow is widely recognized for the creation of a new paradigm for structuring settlements in securities class action cases to ensure that disparate classes of investors each receive a fair voice, both during settlement negotiations and in the allocation of the settlement funds.
