Labaton Keller Sucharow Announces New Partners and Of Counsel for 2021

National plaintiffs’ law firm Labaton Keller Sucharow is pleased to announce it has elected two new Partners and appointed three new Of Counsel, effective January 1, 2021.

“This group of lawyers exemplifies the strength of our practice and service to our clients,” said Chairman Christopher Keller.  “We look forward to their continued development both as lawyers and as leaders, and congratulate them on their well-deserved promotions.”  

The newly elected Partners are:

  • Alfred Fatale III represents investors in cases related to the protection of the financial markets in trial and appellate courts throughout the country.  He is leading the firm’s efforts in litigating securities claims in state courts under Section 11 of the Securities Act of 1933 following the U.S. Supreme Court’s decision in Cyan.  This includes prosecuting In re ADT Inc. Shareholder Litigation, alleging that the offering documents for ADT’s $1.47 billion IPO misrepresented the competition it faced from do-it-yourself home security products, and Stirratt v. Uber Technologies, Inc., challenging Uber's $8.1 billion IPO that premised the company’s growth on an undisclosed, unsustainable, and often illegal “growth at any cost” business model.  Alfred is also an active member of the American Bar Association, Federal Bar Council, New York State Bar Association, New York County Bar Association, and New York City Bar Association.
  • Mark D. Richardson focuses on representing shareholders corporate governance and transactional matters, including class action and derivative litigation.  Mark is actively prosecuting, among other matters, In re Straight Path Communications Inc. Consol. Stockholder Litigation; In re Dell Technologies Inc. Class V Stockholders Litigation; and In re AmTrust Financial Services, Inc. Stockholder Litigation—three class actions pending in the Delaware Court of Chancery.  He recently served as Co-Lead Counsel in a derivative action on behalf of stockholders of AGNC Investment Corp., which settled for $35.5 million.

The newly appointed Of Counsel are:

  • Derick I. Cividini focuses on prosecuting complex securities fraud cases on behalf of institutional investors, including class actions, corporate governance matters, and derivative litigation.  As the Director of E-discovery, he is responsible for managing the Firm’s discovery efforts, particularly with regard to the implementation of e-discovery best practices for ESI (electronically stored information) and other relevant sources.  Derick was also part of the team that represented lead plaintiff City of Edinburgh Council as Administering Authority of the Lothian Pension Fund in In re Lehman Brothers Equity/Debt Securities Litigation, which resulted in settlements totaling $516 million.
  • William H. Schervish serves as Labaton Keller Sucharow's Director of Financial Research and is a key member of the Firm's Case Evaluation Team as well as the Whistleblower Representation Practice.  Bill works to identify and analyze areas of potential misconduct that may expose the Firm's institutional investor clients to risk or damage.  Bill is a Certified Public Accountant, a CFA® charterholder, and a Certified Fraud Examiner.  In addition to his more than 20 years of experience in accounting and finance, Bill is an attorney with extensive knowledge of derivative transactions, asset-backed securitizations, and collateralized debt obligations.
