Partners Carol C. Villegas and Jake Bissell-Linsk and Associates Danielle Izzo and David Saldamando represent consumers in a groundbreaking consolidated data privacy litigation against the fertility app maker Flo Health Inc., Facebook, Google, and other tech companies—a case the team is proud to lead because of its importance to women’s health decisions.

Flo, the maker of an app that tracks menstrual cycles and collects sexual health information, is accused of sharing private medical consumer information with Facebook, Google, and others, without the knowledge or consent of its users in violation of state privacy rules and its own user agreement.

"I've had women who aren't our clients hear about the litigation, and they're just very thankful that someone is taking on Big Tech on behalf of them," Partner Carol Villegas told Law360.  "This is very private information. . . . It’s information that you don't discuss, usually with anyone."

The case has taken on new significance in the wake of the U.S. Supreme Court's reversal of Roe v. Wade.  "Women use [Flo] to get pregnant, and women use it to not get pregnant," she said.  "The implications of that case are pretty important."

Labaton Keller Sucharow serves as co-lead counsel in the case, Frasco v. Flo Health Inc, Case No. 3:21-cv-00757-JD, in United States District Court for the Northern District of California.
